Court lists Nyah cultural heritage case for July hearing

The Supreme Court of Victoria has today listed Wadi Wadi Traditional Owner Vince Kirby's case for hearing on 14 and 15 July 2026.

As part of today's interim proceedings, the Lower Murray Urban and Rural Water Corporation provided an undertaking to the Court that no works will commence to clear the site or begin construction of the Nyah floodplain project until at least the end of the hearing on 15 July 2026.

Environmental Justice Australia represents Mr Kirby in proceedings challenging the Victorian government's approval of a Cultural Heritage Management Plan for part of the Nyah floodplain engineering project.

Mr Kirby argues the approval process failed to properly identify, assess and protect Aboriginal cultural heritage, did not adequately consult Traditional Owners before works were approved, and failed to properly consider his rights under Victoria's Charter of Human Rights and Responsibilities. He is seeking to have the approval set aside.

The Court will hear the matter on 14 and 15 July 2026.
