We welcome the commitment by the Victorian government to proceed with reform of the Environment Effects Statement (EES) process in Victoria. We have been advising on the operation of the EES process under the Environment Effects Act 1978 (EE Act) for almost 20 years. It has long been our view that the EES process in Victoria is operating in the context of an out-of-date and inadequate legislative framework and that this framework should be overhauled and replaced with a comprehensive EIA system that emphasises rigorous, transparent, accountable, participative and deliberative processes designed to protect the environment from inappropriate development.
